Case
Rusty Moore was arrested on May 31, 2024, in the state of Minnesota, for an alleged DWI. However, Moore has disputed these charges. “I am being victimized,” he said.
Recently, an appellate court opinion involving the case was filed in the District Court in the State of Minnesota. Appellate Court Opinion – Nonprecedential Index # 17, STATE OF MINNESOTA IN COURT OF APPEALS A24-1896, Rusty James Moore, petitioner, Appellant, vs. Commissioner of Public Safety, Respondent, was filed on August 25, 2025. Within it are many of the details concerning the matter.
Allegedly – A citizen placed a call to a Minnesota State Patrol trooper. In the appellate court opinion, a summary of the district court’s written factual findings following an evidentiary hearing, along with record evidence, revealed that the call reported that a “tan sedan was ‘driving all over the road.’” The sedan, driven by Moore, was stopped by a Little Falls police officer. Minnesota State Patrol trooper Megan Boser then made her way to the scene. Boser observed what she saw as “signs of possible impairment.” In the end, the state trooper arrested Moore for DWI. No dash cam footage has been released of alleged driving behavior as Presence News knowledge.
Medication
Of the many questions presented to Moore, one of them involved medication. Moore indicated that he has a prescription for Adderall. Boser asked him about it. Moore told Boser that he had taken 30 milligrams (mg) that day as prescribed. He also gave Boser his prescription bottle. In the appellate court opinion, a summary of the district court’s written factual findings following an evidentiary hearing, along with record evidence, mentioned that “the trooper saw a 30-mg pill and a half pill in the bottle.” Boser “believed that a half pill was ‘inconsistent’ with Moore’s prescription.”
Tests
Boser had Moore perform several tests. These are some of them: the modified Romberg test, the lack-of-convergence test (LOC), and the preliminary breath test (PBT). In the appellate court opinion, a summary of the district court’s written factual findings following an evidentiary hearing, along with record evidence, revealed that when the trooper conducted a PBT, it “showed a 0.000 alcohol concentration.” Rusty Moore had no alcohol in his body.
Dash-Camera Video
In the appellate court opinion, a summary of the district court’s written factual findings following an evidentiary hearing, along with record evidence, revealed that “The squad car’s dash-camera video recording (squad video) recorded Moore as he performed the field sobriety tests, but there was no audio.” Moore stated something related to this matter. “The prosecutor in this case emailed my attorney, Anthony M. Bussa, CJB Law, PLLC, Fergus Falls, Minnesota, and said they were going to share all dashcam and bodycam footage,” he said.

Medication
Rusty Moore revealed to Presence News his thoughts on his medication use. He feels he wasn’t doing anything wrong. “I was taking my prescription as prescribed with an oral agreement from my doctor that I could take half a pill on weekends,” Moore said.
Moore also feels that his use of Adderall is tame compared to other people’s dosages. “There’s high schoolers driving to and from school on Adderall,” she said. “I’m on 30 mg; some of these kids are on 60 mg.”
Additionally, Moore revealed his history of using Adderall. “I’ve been taking this medication since the 5th grade,” he said. “Also, driving with a Class A CDL, I’ve logged miles without incident, and higher doses too.”
According to Moore, his license was revoked. He believes this is a problem that resonates among Class A CDL drivers nationwide. Moore provided further comments. “We’re being stripped of our livelihoods” he said.
Dash-Camera/Test
As mentioned, there is footage. However, Moore feels that what most people have seen isn’t everything. “The officer testified in court that the eight minutes of cherry-picked dashcam were a perfect representation of the scene,” he said. “Everybody has seen the video, and it’s not a full representation.”
Moore stated that the footage shows Boser administering the one-legged test. However, he feels there’s still more to the story. Moore commented further on the matter. “She also testified in court that I was so impaired that, for her safety, she had to stop the one-legged test,” he said. “Everyone who has seen the whole video knows that it is not true.” Megan Boser accused of lying under oath.
Updates
Moore revealed that, having the burden of proof, he must prove that he was taking the prescription.
